1. Legal Framework & Key Laws

  • National Building Code (2024) – sets modern standards for design, materials, safety, sustainability and construction practice. Compliance is mandatory for all buildings.
  • National Construction Authority (NCA) Act & Regulations – regulate contractors, project registration, site inspections and professional standards.
  • Physical and Land Use Planning Regulations – require proper building plan submissions and approvals before work starts.
  • Environmental Management and Coordination Act (EMCA) – requires environmental assessment where applicable.
  • Occupational Safety and Health Act (OSHA) – ensures worker safety on site.

 2. Required Approvals before Construction

 a) Building Plan Approval (County Government)

  • Submit architectural and structural plans to your county’s physical planning/ development department.
  • Include land ownership (title deed), survey plan, land rates clearance, and other documents.
  • The county checks compliance with zoning rules, building code, sanitation, fire safety, and public health.
     Building work cannot begin before approval.

 b) NEMA Environmental Approval

  • An Environmental Impact Assessment (EIA) may be required — especially for large projects (e.g., flats, estates, or projects near sensitive environments).
  • A licensed environmental expert prepares the report for NEMA review.
  • Approval ensures the project meets environmental protection standards.

 c) Project Registration with National Construction Authority (NCA)

All construction projects must be registered with NCA before work begins.
Requirements include:
 Contractor & sub-contractor registration with NCA.

  • Approved architectural & structural drawings.
  • Registered professionals (architect, engineer, quantity surveyor) with valid licences.
    Physical planning approvals (county permits).
  •  NEMA and other statutory approvals (if applicable).
  • Bill of quantities, KRA PIN, signed contract documents.
  • After registration, NCA may conduct site inspections during construction.

  • Non-compliance may lead to stop-work orders, fines or demolition.

 5. Certificates after Construction

Once construction is complete:

  • Compliance Certificate – county confirms work matches approved plans.
  • Occupation Certificate – allows legal occupancy of the building.
    These are usually required before connecting utilities or selling/renting the property.
